End User License Agreement
This end user license agreement (this "EULA") is a legally binding agreement between you and Burnoutix and our Affiliates ("we", "our" or "us"). By installing, using or otherwise accessing our services, you agree to the terms and conditions of this EULA. If you do not agree to any term of this EULA, please do not install, use or otherwise access our services.
License Agreement
This EULA was written in English. To the extent any translated version conflicts with the English version, the English version controls.
Scope of License
This EULA applies specifically to:
- The registration and use of your account;
- Your downloading, installing and/or using our services, including any connected software, networks or services;
- Your access to services that are made available by us in relation to the software;
- Any content and information that may be made available to you through the services.
Usage Requirements
You must only use our services if:
- You are of legal age to form a binding contract with Burnoutix;
- You have the power, authority and capacity to enter into this EULA;
- You agree to comply with all applicable laws and regulations;
- You will not use our services for any illegal or unauthorized purpose.
Content and Conduct
You are responsible for your conduct and any content that you create, transmit or display while using our services. You agree not to:
- Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
- Interfere with or disrupt the service or servers or networks connected to the service.
Intellectual Property
All content, features and functionality of our services are owned by Burnoutix and are protected by copyright, trademark and other intellectual property laws. You may not use our trademarks, service marks, or logos without our prior written consent.
Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use and protect your information when you use our services. By using our services, you agree to the collection and use of information in accordance with our Privacy Policy.
Disclaimer of Warranties
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. Burnoutix makes no representations or warranties of any kind, express or implied, as to the operation of our services or the information, content, materials, or products included on our services.
Limitation of Liability
In no event shall Burnoutix, our directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Termination
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.
Governing Law
These terms shall be interpreted and governed by the laws of the jurisdiction in which Burnoutix operates, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
